Further to my earlier post, on checking YouTube today, I find that a "Ad by Google" appears on my Geronimo track. Now, I understand that I can elect to have this and 'Monetise' my video. I gave no such permission. What is going on???

I have had numerous Youtube videos either suspended or with "matched 3rd party content" flags.
Some of the claims were ridiculous, including a recording of the theme from the movie "1492 Conquest of Paradise" (composer Vangelis) which they said was "Vaya Con Dias" ... a totally different tune !
Interestingly, a recording of "How Deep is Your Love" over footage of floods in Wagga Wagga and titled "Wagga How Deep Is Your Flood" was picked up, so they do use music recognition software rather than just rely on the title. Granada was another claimed by Harry Fox even though it was written over 80 years ago.

In each case I went through the simple dispute process, often quoting the "fair use" clause, and in each case the copyright claims were withdrawn within minutes.

Hi George

I can understand your frustration and as you are aware I have had problems with 4-shared who removed all my public access files due to using a tune called Tomahawk that was written and given to us by Mitch Mitchinson.
They couldnt have done it on tune recognition as the tune was never registered as copyright by Mitch. I'm assuming they either used the title or did it randomly.

I sent them and their agents DMCA numerous emails but they wanted me to go through their process of counter claims. This process takes hours of work and as they falsely accuse me in the first place, I told them they could go jump.
I will be transferring my files to either BOX or my son in laws website that has 200gb free.

So its guilty until proven innocent with these people.

Let me just say that any covers we do of our beloved Shadows for fun is a promotion of them. Look at all the sites world wide that are promoting their music due to our search and research for the holy grail.
Most of us are in our 60's and these clowns want to take away that little bit of fun we have during our senior years. Its disgraceful.

I just got a take down email from 4Shared for a recording of "40 Miles of Bad Road" which used the BT from UB Hank 4.

I had already posted details over in this thread http://shadowmusic.bdme.co.uk/viewtopic.php?f=11&t=7733&p=67801#p67799 when Justin pointed me in this direction.

I have written permission from Mustang Music, who publish the CD, to play along to to the tracks and post them on the internet, so I am wondering who is claiming the copyright? If not the publishers of the track, could it be the owners of the published music.

Could this flurry of 'attacks' be a result of the recent change to the UK copyright law that extends copyright to 70 years from 50 years? BTW, Duane Eddy recorded the tune back in 1958.

I think these people take random shots around hoping they may get lucky.

I have recently moved away from 4 shared to the BOX.
These "do gooders" take out all the fun out of music for us old folk...its downright disgraceful.

I've come a bit late to this discussion, but no one seems to have followed up Bob's question above. The answer is, if someone claims copyright, but doesn't want the audio muted or taken down, Youtube put Ads on the video and/or the video page, and the owner of the copyright gets any income thus generated. Youtube have deals with most of the major publishers for this. This is Youtube's way of keeping so much otherwise 'illegal' audio/video up there. (As Ecca says, if all copyright items were removed, audio or visual, it would kill YouTube.)

I'm not aware whether 4shared (having read the other thread) have any such deal with copyright owners, I don't use it, and the system they use may not lend itself to the 'advert income' solution applied by Youtube.

So far, none of my Shadows/Shadowmania videos on Youtube have had any audio muted, although almost all have the 'matched third party content' comment added. Some have adverts, some don't. My upload of The Shadowers 'The Savage' from Shadowmania 2012 has a copyright notice from Warner Chappell and SACEM but it's fully playable and has no adverts. Ditto a copy of the original clip from 'the Young Ones' as well. Why the same 'rules' don't seem to apply to all uploads, as I see from this thread that lots of videos of The Savage have been muted and 'warnings' re copyright have been a lot heavier, I don't know. Weird!

Just to update regarding The Cardboard Box Mix..I went through the process of disputing back in April because the audio had been removed. Going through this process re-instates your audio pretty much immediately, the video then gets marked with a date (30th June in this case) that the copyright holders can make a counter claim. Well, this date came and went with the video now having no comments tied to it at all eg. Acknowledged Third Party Content.

I've heard a similar account where YouTube is concerned.
There's plenty of useful insight in this thread.
Seems we can get round these obstacles if we just query the action when it's taken.
